Overview
The attorneys at Parsons Behle & Latimer regularly advise clients on all aspects of hazardous substances, hazardous waste and solid waste management, including permitting, transportation, compliance counseling, corrective action and litigation. We have assisted clients in obtaining solid and hazardous waste permits. We participate as counsel in environmental audits and environmental management systems involving RCRA compliance. We regularly assist clients regarding opportunities for avoiding the applicability of hazardous waste permits through recycling and various on-site management options. For clients whose activities require a RCRA permit, we are experienced in assisting them with all aspects of permit compliance, including corrective action responsibilities. We have extensive experience counseling manufacturing and mining clients on the intricacies of the “definition of solid waste” under RCRA. We regularly counsel our mining clients on the scope of the Bevill Amendment and have defended them in complex litigation interpreting the Bevill Amendment. We also represent manufacturing and mining companies in rulemaking and legislative initiatives in the West and at the federal level.
Additionally, our attorneys have defended numerous clients in civil and criminal enforcement actions (administrative and judicial) by federal, state, or local regulatory agencies alleging violations of solid and hazardous waste laws. Through that work, we have developed key and longstanding relationships with agencies throughout the West and in Washington, D.C. We have also successfully defended industrial clients against RCRA citizen suits.
