An Appeal and Request for Reconsideration was filed by Parsons on behalf of their client on June 1, appealing the denial of the application for the data center project by the Pocatello Hearing Examiner’s Office.

Lex Developments, an Arizona company, is proposing a redevelopment of the former Hoku Materials plant in Pocatello into an AI data center. The company has formally appealed the denial of its conditional-use permit application that would allow it to proceed with the project. Filed by Parsons, the appeal contains three primary arguments, contending that the city made procedural and legal errors and is now asking the Pocatello City Council to reverse the hearing examiner's decision. The City Council has not set a date for when it will hear Lex Developments’ appeal and request for reconsideration.
