Homeowners Associations

When Mr. Stenquist started his career in Houston, he lived in the largest Homeowner’s Association in the country The Woodlands, Texas. This HOA sparked his interest in planned communities. Consisting of over 50,000 members, this HOA contracted its own fire, police, public works and managed a substantial parks and recreation department. He has since represented dozens of HOAs. He has drafted and amended many CC&Rs, prepared bylaws and corporate documents and has advised HOAs and their members on governance and enforcement issues. His experience in litigation has naturally led to substantial HOA litigation.

Idaho Supreme Court – Successful Defense of Lender Liability Claims

Mr. Stenquist represented JP Morgan Chase Bank, N.A. and successfully obtained summary judgment against borrowers who raised multiple counterclaims including bad faith and predatory lending practices. Chase obtained, and the Supreme Court held, that the district court did not err when it granted lender’s motion for summary judgment and denied the borrowers’ motion to amend the counterclaims to add a fraud claim. The Supreme Court concluded that the borrowers’ appeal was frivolous under Idaho Code Section 12-121 and awarded Chase attorney fees on appeal.

Corporate Formation, Purchase and Sale Documents

Mr. Stenquist has negotiated, drafted and closed dozens of business mergers and acquisitions. His work has involved the transfer of significant real estate and intellectual property. These transactions include negotiating and drafting non-compete agreements and confidentiality provisions. He also regularly assists clients with business continuation issues. With assistance from the employment practice group, he often advises clients in employment related matters.
