Parsons Behle & Latimer attorneys J. Kevin West and Andrew R. Alder recently received a significant verdict in a medical malpractice matter. West and Alder represented a Twin Falls chiropractor who was sued by a patient alleging the chiropractor caused him to suffer a cerebellar stroke. The stroke occurred on the same day the chiropractor adjusted the plaintiff’s neck.  Due to the stroke, the plaintiff lost his job and has permanent disabilities. At trial, plaintiff’s counsel asked the jury to award $600,000 to his client, including $120,000 in medical expenses.

During the trial, the defendant’s attorneys produced a total of eight experts from the specialty fields of chiropractic medicine, neurology, neuroradiology, neuropsychology and neurocritical care. There were also three to four treating doctors who testified. Most or all of the plaintiff’s treating doctors took the position that the stroke was caused by the Parsons’ client, the chiropractor.

West and Alder produced their own experts who did an outstanding job of countering that the stroke was caused by the plaintiff’s longstanding and widespread atherosclerosis.

At the conclusion of the two-week trial, the jury agreed with Parsons’ experts and attorneys’ counter arguments and ruled in favor of the defendant, after deliberating for only 30 minutes.
