Eric Johnson is an attorney in the litigation practice group at Parsons Behle & Latimer. Eric has recently represented clients in matters involving, among other things:

Before joining Parsons Behle & Latimer, Eric served as an Assistant Attorney General (AAG) with the Office of the Attorney General for the District of Columbia. As an AAG, Eric represented the District of Columbia in complex and high-profile civil litigation, including constitutional challenges (First Amendment, unlawful takings, procedural and substantive due process), putative class actions, and employment litigation involving high-ranking former government officials. Earlier in his career, Eric worked as a Trial Attorney with the Federal Energy Regulatory Commission’s Office of Administrative Litigation.

Eric received his J.D. from the New York University School of Law, where he served as a Notes Editor for the NYU Journal of Law & Liberty. After law school, he served as a law clerk to U.S. Magistrate Judge Evelyn J. Furse in Salt Lake City and then to U.S. District Judge Sandra L. Townes in Brooklyn, N.Y.

Experience

Bad Faith Insurance Prosecution

Obtained a jury verdict for a plastic surgeon client in a lawsuit against his insurance carrier for breach of the duty of good faith, then won on cross-appeal the right to pursue a punitive damages claim on his behalf. his medical malpractice insurer. 

Breach of Commercial Real Estate Lease

Obtained nearly $60 million judgment representing landlord in counterclaim against tenant involving properties in Utah, Oregon and California.

Data and Monitoring Service Client

Lead counsel for LegitScript, LLC a leading provider of data and monitoring services to e-commerce companies, credit card processors and banks and government agencies in a lawsuit filed by nutritional supplement companies in Utah. Plaintiffs asserted various claims under the Lanham Act for false advertising as well as defamation and intentional interference. Settled on terms favorable to the client.
