Permitting & Regulatory Compliance

Overview People in this Area

We have considerable experience performing environmental due diligence, assisting with all stages of mine permitting, and advising regarding regulatory compliance matters.

Parsons Behle & Latimer regularly assists mining companies in all stages of permitting a mining project, from exploration to reclamation and closure. Our permitting team has guided clients through hundreds of NEPA environmental assessments and environmental impact statements and various other permitting processes, from the simplest notice of intent to the most complex plan of operation. This includes ensuring compliance with the many resource protection laws applicable to public lands including the National Historic Preservation Act, the Endangered Species Act, the Migratory Bird Treaty Act, and the Eagle Protection Act. By being members of the permitting team, our attorneys ensure that the best possible record is created in the event that project opponents file an appeal. We regularly assist clients in the defense of their project permits, in both agency and judicial appeals, and have the experience needed to maximize the chances of a favorable outcome.

Additionally, our mining attorneys routinely advise mining clients regarding regulatory compliance issues and have assisted numerous clients in preparing and implementing the reclamation and closure plans necessary to responsibly and legally close an operation.
