EMPLOYMENT LAW BY THE NUMBERS

During the time I have been practicing employment law, the details and nuances of the various legal requirements and prohibitions as well as the sheer number of employment laws enacted on the federal and state levels have been staggering. By my rough calculation, the number of statutes enacted during my tenure as an attorney that directly affect private employs in Utah, has increased by nearly 50 percent. This does not include minor amendments to existing statutes, newly issued administrative agency rules or common-law (non-statutory) doctrines. It also excludes any laws that relate solely to public sector employers. To further complicate matters, whether a particular law applies often depends on the number of employees of a particular employer. 

Years ago, to help myself keep up with this continuously changing legal landscape, I assembled a list of employment laws that apply to private employers in Utah, broken down by number of employees. I have maintained this list over the years. What once fit comfortably on two pages now requires three. 

I have found this list useful in reminding myself and my clients of the various employment laws that apply to them in Utah and that come into play as they add employees. Keep in mind, however, that this list is current only as of this date, and the number of employment laws that affect your operations is likely to continue to grow.
