If you are a large employer (private employers with 100 or more employees and certain federal contractors with at least 50 employees), you are likely familiar with the EEO-1 Report. An EEO-1 Report (Employer Information Report or Standard Form 100) is an annual survey mandated by the U.S. government. It requires covered employers to submit, on an annual basis, demographic workforce data, categorizing employees by race/ethnicity, sex and job category. On May 14, 2026, the EEOC sent a proposal to the White House to end the EEO-1 reporting requirement. The EEOC’s proposal will not be made public until it is reviewed by the Office of Information and Regulatory Affairs.
We do not know if or when the proposal will become final or whether it will impact this year’s reporting cycle. For now, you should still gather the information for your EEO-1 statement (choosing a reporting period for 2025 between Oct. 1, 2025, and Dec. 31, 2025, identifying job categories, allowing your employees to self-identify their sex and race/ethnicity, and providing a statement to employees regarding the voluntary nature of the inquiry) and then wait to see if the reporting portal opens or if it is delayed or cancelled for 2025 based on the proposed rule change.
